Oakdale man cited for offering beer to child

The evening of April 16 in the 5000 block of Hadley Avenue near Castle Elementary School in Oakdale, a juvenile said a man offered him beer and invited him to a “hiding place.”

Oakdale police tracked the man down and cited Justin James Hiveley, 34, for disorderly conduct. A court date is pending. 

The juvenile told police that Hiveley, who the child didn’t know, wearing dark clothing and riding an older black bike with a basket full of beer, stopped and began talking to him, according to an Oakdale police statement. Hiveley then backed off from the child after seeing another person approaching. 

Police located Hiveley and his bike at his Oakdale residence. When police attempted to talk to him, the statement said, Hiveley ran into his garage and shut the odor, refusing to make contract. 

Oakdale police did not criminally charge Hiveley right away, opting to forward the case for city attorney review. The city attorney determined a disorderly conduct charge was appropriate, and Hiveley was cited on April 18. The case remains open, police said.

“The juvenile and witness involved in this case did exactly what we would hope for,” police said in the statement. The child rode away and asked an adult for help, and the witness provided descriptive information to help police identify Hiveley.

Due to the incident happening around 7 p.m., police said Castle Elementary was not notified. “However, parents are encouraged to discuss personal safety with their children when they are walking or biking anywhere unsupervised,” police said.

The Oakdale PD statement said the area will be routinely patrolled.
