The Summary of Amendments to the Ramsey County Solid Waste Designation Ordinance are listed below; a copy of the entire Ordinance, as amended, can be obtained by calling the Chief Clerk – County Board at 651-266-8014. A printed copy of the Ordinance is also available for inspection by any person during regular office hours at the office of the County Auditor. In January 2016, the Ramsey/ Washington Recycling & Energy Board, on behalf of Ramsey County (the “County”) and Washington County (collectively, the “Counties”), became the owner of the Recycling & Energy Center (“R&E Center”) located in Newport, Minnesota. Now, pursuant to the Counties’ Joint Waste Designation Plan that was approved by the Minnesota Pollution Control Agency in November 2016, the Counties are amending their respective solid waste ordinances in order to implement solid waste designation. The amended Ramsey County Solid Waste Ordinance (the “Amended Ordinance”) requires that all waste generated within Ramsey County that is acceptable at the R&E Center be delivered to the R&E Center. The current solid waste delivery network will remain largely intact under the Amended Ordinance as the Recycling & Energy Board will continue to enter into waste delivery agreements with haulers. Acceptable Waste collected by haulers that enter into waste delivery agreements with the R&E Board will not be subject to the provisions of the Designation Ordinance and such haulers may deliver their loads to transfer stations that have entered into a transload agreement with the R&E Board. Thus, designation acts only as a regulatory “safety net” that catches Acceptable Waste that would not otherwise be delivered to the R&E Center. 1. Definitions The Amended Ordinance amends a number of existing terms that are used throughout the County Solid Waste Ordinance in order to conform to the Joint Waste Designation Plan. In addition, the Amended Ordinance adds a definition to the waste designation section (Recycling & Energy Board) that applies only within the waste designation section. 2. Delivery Requirements The Amended Ordinance establishes the effective date of waste designation as January 1, 2018, lists the people and entities subject to waste designation, and sets forth the procedures for delivering Acceptable Waste to the R&E Center. Designation applies to all persons who generate, or collect such waste within the County, including haulers and self-haulers. This includes a provision that allows haulers that enter into waste delivery agreements with the R&E Board to comply with waste designation by delivering waste to a transfer station that has entered into a transload agreement with the R&E Board. 3. Acceptable and Unacceptable Waste The Amended Ordinance defines what waste may be delivered to the R&E Center and what waste may not be delivered to the R&E Center. In addition, it outlines the authority to inspect waste delivered to the R&E Center and reject prohibited waste. 4. Interruption of Waste Designation The Amended Ordinance details the manner in which the County may interrupt waste designation and suspend the requirement that all waste generated in the County be delivered to the R&E Center. 5. Tipping Fees The Amended Ordinance delegates to the R&E Board the authority to establish or amend the tipping fee for delivery of waste to the R&E Center, and list principles for the R&E Board to consider when establishing or amending the tipping fee. 6. Exemptions and Exclusions The Amended Ordinance lists the types of waste that are exempt from waste designation requirements, which include: X materials that are separated from mixed municipal solid waste by the generator and recovered for reuse; X recyclable materials; X materials that are processed at a resource recovery facility at the capacity in operation at the time that the Joint Waste Designation Plan was approved; and X materials that are separated at a transfer station that has a license and is located within Ramsey County for the purposes of recycling the materials, provided that the transfer station was in operation on January 1, 1991 or the materials were not being separated for recycling at the R&E Center at the time the transfer station began separation of the materials.
